Terms of Service

These terms govern use of the SolaSpark website and preliminary services. A signed project proposal or contract will contain the final commercial and technical terms for an installation.

1. Acceptance and scope

By accessing the SolaSpark website, using its calculator, contacting us, or requesting a rooftop survey, you agree to these Terms of Service. If you do not agree, do not use the website or submit information.

These terms cover the website, enquiries, free surveys, preliminary estimates, and service communications. A solar installation, financing arrangement, or paid service is also governed by the written quotation, proposal, work order, loan agreement, warranty document, or other contract accepted for that service. If a signed project document conflicts with these website terms, the signed project document controls for that project.

2. Eligibility and authority

You must be at least 18 years old and legally capable of entering a contract to order paid services. If you act for a property owner, business, housing society, or other organization, you confirm that you have authority to provide information and make decisions for that party.

3. Acceptable website use

You may use the website for lawful personal or business evaluation of SolaSpark services. You must not attempt to disrupt the website, bypass security, submit false or misleading enquiries, impersonate another person, scrape the service at scale, introduce malicious code, or use website content in a way that infringes another party's rights.

4. Free survey, calculator, and estimates

A free survey request is an invitation to evaluate a potential project; it does not require you to purchase and does not require SolaSpark to accept a project before feasibility is confirmed.

Calculator results, generation estimates, savings, bill reductions, payback periods, system sizes, subsidy amounts, EMI examples, and timelines shown on the website are indicative. Actual results depend on roof structure and area, shading, orientation, equipment, weather, dust, tariff, load profile, export rules, grid availability, government policy, customer usage, and other site-specific conditions.

Do not make a purchase or financing decision solely from a website estimate. The project proposal issued after technical review contains the applicable design assumptions and commercial figures.

5. Quotations, pricing, and payment

A quotation is valid only for the period stated in it and may depend on site access, structural suitability, equipment availability, taxes, subsidy assumptions, and scope. Work begins according to the payment milestones and acceptance process in the quotation or contract.

Any additional work caused by concealed site conditions, customer-requested changes, unsafe electrical systems, structural reinforcement, non-standard routing, or authority requirements will be discussed and documented before it is charged where reasonably practicable.

6. Subsidies, net metering, and approvals

SolaSpark may assist with portal registration, documents, feasibility, inspection, net metering, and subsidy claims. Eligibility, amount, approval, processing time, and payment are decided by the relevant government body, DISCOM, bank, inspector, or scheme administrator. SolaSpark cannot guarantee a third-party approval, subsidy payment, or processing date.

You are responsible for providing complete, accurate, current, and authentic documents and for signing or verifying applications when required. Delays or rejection caused by missing, inaccurate, inconsistent, or ineligible information are outside SolaSpark's control.

7. Financing

Loan and EMI information is illustrative unless issued by a lender. Credit approval, interest rate, fees, security requirements, repayment schedule, subsidy treatment, and disbursal are decided by the lender under its own terms. SolaSpark is not the lender and does not guarantee approval unless a separate written agreement expressly says otherwise.

8. Customer responsibilities

You must provide safe and timely access to the property, disclose known structural, waterproofing, electrical, title, access, or dispute issues, and obtain required owner, society, landlord, lender, or local permissions unless the project contract assigns a specific task to SolaSpark.

You must protect installed equipment from unauthorized alteration, follow operating and safety instructions, maintain required grid connection and insurance where applicable, and promptly report visible damage or abnormal performance.

9. Installation, performance, maintenance, and warranties

Installation scope, equipment brand and model, design capacity, workmanship terms, maintenance coverage, monitoring, expected generation, exclusions, and handover requirements are defined in the accepted project documents.

Panel, inverter, and other product warranties are provided under the applicable manufacturer terms. References to a 30-year panel warranty generally concern the specified panel manufacturer's warranty and remain subject to its conditions, exclusions, registration, transfer rules, and claims process. Any SolaSpark maintenance or workmanship commitment applies only as stated in the accepted quotation or warranty document.

Generation and savings are affected by weather, soiling, shading, grid outages, export restrictions, equipment availability, customer consumption, and maintenance. A performance promise, including any SparkSure™ commitment, applies only where included with defined measurement and remedy terms in a signed project document.

10. Project changes, cancellation, and delays

Survey rescheduling, order changes, cancellation, refunds, equipment substitutions, and delay consequences follow the accepted quotation or contract. Amounts already spent on customized design, applications, procured equipment, transport, or completed work may be non-refundable where the contract permits.

SolaSpark is not responsible for delay caused by unsafe conditions, weather, customer access, document issues, utility or government processing, grid work, supply disruption, transport interruption, civil disturbance, natural events, or other circumstances beyond reasonable control. We will communicate material delays and resume work when reasonably possible.

11. Third-party services and links

The website may link to WhatsApp, government portals, DISCOM systems, lenders, manufacturers, maps, or other services. Those services are operated independently and their terms, privacy practices, availability, and decisions apply. A link or introduction does not make SolaSpark responsible for a third party's service.

12. Intellectual property and responsibility

The SolaSpark name, branding, website copy, designs, reports, graphics, software, and other materials are owned by or licensed to SolaSpark. You may use a project proposal or report for evaluating your own project, but may not reproduce, resell, publish, or commercially exploit protected material without permission.

To the extent permitted by applicable law, SolaSpark is not liable for indirect, incidental, special, or consequential loss arising only from use of the website or reliance on preliminary estimates. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits rights available to a consumer under applicable law.

13. Governing law, disputes, and changes

These terms are governed by the laws of India. Subject to mandatory consumer rights and any dispute process agreed in a project contract, courts with lawful jurisdiction in Rajasthan will have jurisdiction. The parties should first attempt to resolve a dispute in good faith through written communication.

We may update these website terms as services, technology, or law changes. The updated terms apply from the effective date shown on this page. Changes do not rewrite an already signed project contract unless the parties agree in writing or applicable law requires it.
